What is ADR – Alternative Dispute Resolution

HMRC uses officers who have been trained in mediation and facilitation techniques to broker deals in cases that have reached an impasse. Lindsay has attended these and had great success is reducing tax liabilities, but it needs care as it is a one-off offer on the table

ADR started almost 10 years ago as an ‘independent’ process to assist in resolving tax disputes or issues arising from ongoing enquiries and investigations.

It can be used whenever there is a stalemate situation and can be used in a variety of tax investigations.

ADR involves an independent officer from within HMRC who has not previously been involved in the case reviewing it and mediating between the client and the HMRC officer dealing with the case to try to broker an agreement between the parties.

It has proved a very worthwhile process to have a different eye cast over the issues and conduct of the case and it does not prevent the client still going to a Tribunal system or their rights for the internal review.
