Can HMRC Publicly ‘name and shame’?

HMRC publish the names of deliberate tax defaulters on their website. This is commonly referred to as ‘naming & shaming’.

This is a person who, during a tax investigation has been charged a penalty for deliberate errors or who has deliberately failed to comply with the tax legislation.

You may avoid being ‘named & shamed’ but only if your conduct during the investigation was excellent throughout and means that you received a maximum reduction of the penalties.

Working with Lindsay from day one, ensures every effort is made continuously to obtain those maximum reductions and therefore avoid the naming on the HMRC website for all to see.

If you are caught by the naming & shaming regime, your details, including your personal or trading name, address, and the amounts of tax and penalty charged, will appear on the HMRC website for 12 months.

Look at it as a deterrent to you, which is the intention of HMRC as it can have more severe implications with e.g., banks, business suppliers and customers.

HMRC’s penalty powers are extensive but with an experienced, confident and sympathetic adviser on board like Lindsay such sanctions can be avoided.
